Builders & Building Regulations

Before you agree a contract with your builder, it is important to consider the building regulations your project may be subject to. Building regulations are not the same as planning permission. Planning permission may also need to be sought for your project, contact your local authority for advice. If you are employing a Builder the responsibility for building regulations will usually be with them, but remember to check this when signing a contract. However it is important to note that as you are the owner of the building ultimate responsibility may lie with you and if regulations are not met you could be subject to an enforcement notice.

What are building Regulations?

Building regulations are national regulations which apply may different types of building projects. The building regulations are in place to ensure certain safety regulations, to protect public heath and welfare. 

Are all projects subject to building regulations?

No there are a number of extensions on existing buildings or new builds which are not subject to building regulations. However size, construction and the position in the boundaries, may need to be meet. Examples of projects which may not need to meet building regulations: 

  • Porches
  • Garden Sheds
  • Greenhouses
  • Conservatories

These however, may be subject to planning permission. Contact your local authority for advice and to see if your project is subject to building regulations.

Applying for Building Regulations

To apply for building regulations yourself, your builder or your architect must contact your local authority’s building control officer. You will then be instructed to fill in a form, which will include the details of your project. Your local authority will then approve your project or ask to see more information before they make a decision. approval usually takes around 6 -8 weeks.
